Terms of Service

1. Nature of Service

Eternal Record allows users to permanently inscribe digital content onto the Bitcoin blockchain using Ordinals inscriptions. Our service acts as a facilitation layer only—similar to a browser or search engine—enabling you to initiate blockchain transactions. We do not control, host, or distribute the resulting on-chain data.

2. No Accounts Required

Users may use the service without creating an account. Email addresses are collected for transaction-related communications and optional marketing.

You retain ownership of content you submit.

By submitting content for inscription, you represent and warrant that:

• you have the legal right to submit and publish the content,
• the content does not violate any law, including laws prohibiting child sexual abuse material (CSAM), malware distribution, or material support for terrorism,
• the content does not infringe intellectual property rights of any third party,
• the content does not include illegal, hateful, or abusive material,
• the content does not include non-consensual personal data or images,
• the content does not involve minors in any manner.

Eternal Record does not review, moderate, pre-screen, or verify user-submitted content prior to inscription. We are a technical facilitator only.

You are solely and exclusively responsible for all content you submit and the legal consequences thereof.

5. Right to Filter & Refuse Service

Technical Filtering Mechanisms:

• All submitted files are processed through SHA-256 cryptographic hashing to generate unique content signatures.
• Content hashes are checked against a maintained database of prohibited material (updated in response to legal notices, law enforcement requests, or content moderation policies).
• Matching content is automatically rejected before transmission to the blockchain, with a clear error message.
• We maintain an IP-based rate limiter (5 inscription attempts per hour) to prevent automated abuse.
• A strict file size limit (350KB) is enforced to discourage bulk data distribution.

Discretionary Refusal: Beyond automated filters, we reserve the right to refuse service prior to inscription at our sole discretion, including but not limited to:

• Suspected violation of these Terms
• Patterns of abuse or circumvention attempts
• Regulatory or legal concerns
• Technical limitations or service capacity constraints

Important: These filters operate before blockchain inscription. Once content is inscribed on the Bitcoin blockchain by any means, it becomes immutable and publicly accessible. Our filtering only applies to content submitted through the Eternal Record interface.

All sales are final.
No refunds are issued once an inscription is broadcast or completed.

7. No Financial or Legal Advice

Eternal Record does not provide financial, investment, or legal advice.

8. Service Availability & Risks

We do not guarantee uninterrupted service availability, inscription timing, or protocol stability.

9. Limitation of Liability & Removal Limitations

To the maximum extent permitted by law, Eternal Record shall not be liable for any indirect, incidental, consequential, special, or punitive damages arising from use of the service, including but not limited to: damages resulting from inscribed content, blockchain permanence, inability to modify or remove data, third-party actions, or network failures.

Maximum liability is limited to the amount paid for the specific inscription service.

10. Governing Law & Venue

These Terms are governed by the laws of the State of Montana.

Venue shall lie exclusively in Montana state or federal courts.
